ACLU's Laura Murphy Says Debt Crisis Manufactured

Even if the debt ceiling is raised, hard decisions will be made about which federal programs will continue and which ones won’t. The civil liberties consequences of those choices are not entirely predictable, but some are. We can already see that higher unemployment rates and the foreclosure crisis are creating a widening racial wealth gap. Stocks and bonds are not yielding the same return for pensions and 401Ks that working people earned and depend on for their survival in retirement. The middle class is shrinking and poverty is deepening.

The ACLU believes that "natural" economic differences alone cannot explain widespread poverty. Out of proportion to their numbers, the poor are denied adequate legal representation, due process, the right to be free from unlawful searches, seizures and arrests, and other constitutional guarantees. 

The controversy over the debt ceiling is a totally manufactured debate that came about because many Republican House members signed a pledge not to vote to raise it. But the widening economic crisis is real. It will have very real implications for the ACLU’s work for decades to come.

NOTE: AAEA believes the ACLU concerns line up with our concerns over a lack of Black ownership in the energy sector.

Blacks Do Not Own Any Energy Resources or Infrastructure

And The Energy Sector Does Not Care

Blacks do not own the oil, natural gas, coal, electricity, pipelines, electricity transmission lines, refineries, tankers, oil fields, outer continental shelf drilling platforms, power plants, or oil, gas, coal mines and utility companies that distribute energy in the United States. Blacks, who make up 13% of the American population, also do not exert influence from the demand side of energy use. We do not own, distribute nor use energy to our advantage. Blacks must utilize energy policy to become owners and suppliers of energy.

One response to this dilemma is "buy stock."  Well not even the oft cited Oprah has enough money to buy enough stock to own an ExxonMobil or a BP. But what about the smaller energy companies?  Well the energy business is very capital intensive and involves significant federal government subsidies.  An 'Oprah' would have to commit all of her considerable wealth to get a foot in the door of even a small energy operation. Moreover, Blacks have been designated, and appear to be restricting themselves, to the green energy sector.  Yet the renewables sector of the energy economy (less hydro) represents less than 1% of the energy marketplace.  Some seem to want to keep Blacks in the conservation and renewables section of the energy sector.

The energy sector is not about to voluntarily incorporate Blacks into ownership positions when it comes to resources and infrastructure.  The federal government is not going to facilitate such ownership out of the goodness of its heart.  AAEA has spent decades trying to work with the energy industry in order to gain equity.  Even when the projects would have significantly helped in getting approval, prospective partners appeared to prefer to let the project fail instead of partnering to possibly give the project a prospect to be approved. And low-rating AAEA is not the answer because no Blacks own energy infrastructure and resources in the United States.

Blacks are hired as vice president for government relations, outreach or human resources in corporate energy America.  They represent much of the membership of the American Association of Blacks in Energy.  Just as the handful of Black professionals working at environmental groups are restricted to the environmental justice area within the group.  Energy corporations utilize these vice presidents to attend Black conferences, sponsor certain events and in some cases, serve as the gatekeeper to proposals for various forms of Black participation.  Energy companies enthusiastically see this as their significant contribution to 'minority outreach.' Some of these vice presidents reach out to the extent that they can, but they cannot green light an ownership stake in the company.  They can, and probably should, be reluctant to promote an proposal that could threaten their high-paying job.  Part of our frustration comes from seeing some energy corporate executives getting multimillion dollar cash and stock bonuses for running the companies into bankruptcy.

So we know the problem.  What is the solution?  One solution is the Congressional Black Caucus (CBC).  The other solution is international energy trading.  The federal government owns a great deal of land that is a storehouse of energy.  Some of this land needs to be privatized and targeted to Black ownership or control.  The CBC must insist that if energy companies want access to energy public lands, they must partner with Black-owned energy firms.  The CBC should also insist that current energy leases include Black ownership stakes.  These resources belong to the American people but Blacks have been completely excluded from participating in this area.  It takes a huge investment to develop energy reserves and the only practical way to accomplishment energy market penetration is to partner with companies that have the capital to develop the resource.

Nigeria has the best crude oil in the world.  African Americans and Nigerians should own, control and trade this precious resource.  The current corporations can still be minority partners, but ownership is its own reward.  This same ethic goes for other natural resources throughout Africa, particularly rare earth elements.  Again, the CBC is the nucleus of formulating this international trade.  Ownership stakes in international trade (owning tankers, cargo ships, ports, resources, etc) combined with ownership of infrastructure and resources in the United States will put Blacks squarely in the energy sector.  Hopefully, such equity and wealth generation can go far in reducing the staggering unemployment in the Black community. To Joke or not to Joke



Humor is one of the joys of life and also a great stress reliever. But what topics are out of bounds? When does humor land you in hot water? Is life too serious to joke about anything?

I've struggled with these questions and flip flopped on the answers my whole life. I've been guilty of attempting to make light of the way European-Americans talk vs African-Americans. Maybe some of you are upset at even the thought that I would dare to step into that controversial stereotyping. I have also been easily offended myself when a co-worker made a racist joke about refried beans. He even made the joke at work. wtf iwwsp (what the f is wrong with some people)

If you're not a professional comedian stay away from the sensitive areas of race, culture, class, ethnicity, and handicaps. Call me boring, but is it really worth sounding like a racist a-hole for a few chuckles?

Switching gears to my serious topic. I'm talking about immigration policy with a family member. (I know. Bad idea.) When this family member says "The problem is that immigrants are draining the system!", and (as if that wasn't enough) "If we open the boarders ALL Mexicans will be up in the U.S.!"?

To put you in my shoes -- in the SAME room is my Mexican wife and my 6 year old Chicana daughter. I kid you not.

I had played this scene over and over in my head before I even realized that I could have made a joke out of it. I could have said "I know huh!? What should we do with them!?" "(insert cruel and unusual punishment up to and including genocide)" Now, if I did say that, the problem is that I don't think six-year-olds are good at understanding sarcasm and devil's advocate. I suppose I should have turned the whole situation into a teaching moment of how to use sarcasm in a humorous way and how to play devil's advocate.

My problem is -- when someone is offensive -- I'm not in a laughing mood anymore.

Today the President of the United States announced his intent to nominate Dot Harris of Atlanta, Georgia to be his Director of the Office of Minority Impact and Diversity for the United States Department of Energy. Since 2006, Ms. Harris has served as the National Secretary of the American Association of Blacks in Energy, and the chair of the Association’s Energy Entrepreneur Committee. Dot Harris is currently President and CEO of Jabo Industries, LLC, a minority-woman owned management consulting firm concentrating primarily in the energy, information technology, and healthcare industries.

Before joining GE, Ms. Harris was an officer and Vice President of Operations & Production for ABB Service, Inc. She also spent twelve years as Field Services Engineer and Services Manager with Westinghouse Electric Company. Ms. Harris currently serves as the National Secretary for the American Association of Blacks in Energy.

Environmental Professionals of Color- National

The Environmental Professionals of Color- National (EPOC National) is a network of leaders, many of whom are the only person or one of the few people of color working at their environmental institutions. The purpose of this network is to provide a safe space for connecting people of color across the U.S. to share information, provide support, and discuss in depth the issues we care about.

EPOC National members work on a diverse array of environmental issues, including conservation, global warming, sustainability, environmental health, an environmental justice. They fill a unique and valuable role as bridges between the environmental community and communities of color.

A Piece of the World Trade Center Arrives

A 4-foot, 215-pound piece of steel rectangle arrived on the flatbed of a Department of Public Works truck July 19th in Franklin Lakes, New Jersey. The piece of steel will be permanently installed at Memorial Pond (dedicated in 2003 in memory of four residents killed in terrorist attacks 9/11).
Those in attendance greeted the steel by taking pictures of it. By noon, it was in the firehouse, where it will stay until officials decide where to place it at the pond.
 The pond is behind Borough Hall and adjacent to Muni Field.
The final phase of the pond project — the creation of a waterfall — is in progress and will be completed in time for the 10th anniversary of 9/11, officials have said. A commemorative ceremony will be held at 4 p.m. Saturday, Sept. 10, at the pond.

Overtake America? Seriously?

Is the United States losing status as a global superpower?
A new Pew Global Attitudes survey finds that while the U.S. is better regarded around the world now than it was in the Bush years, in 15 of 22 nations surveyed most say that China either will replace or already has replaced America as the world's "leading superpower." This view is especially widespread in Western Europe, where at least six in 10 respondents in Britain, France, Germany and Spain see China eventually overtaking the U.S.

Maryland Board Approves Solar Farm Lease at Prison Site

The Board of Public Works voted 2-1 on Wednesday to lease about 250 acres of state prison land in Western Maryland to Maryland Solar to develop the state’s largest solar energy farm. The 20-megawatt solar project is being developed by Easton-based Maryland Solar LLC next to the medium-security Maryland Correctional Institution near Hagerstown. Construction will create about 125 jobs and boost the state’s efforts to increase renewable energy. The payment in lieu of taxes for Washington County of $2.4 million does not use state dollars or state risk. The terms of the 20-year lease call for the company to pay the state $32,050 a year, with a 3 percent increase after the third year.

Maryland Solar was created by Beowulf Energy, whose managing director, Michael Enright, served as Gov. Martin O’Malley’s chief of staff and senior adviser before he left the administration last year. O’Malley, who sits on the board with Franchot and Treasurer Nancy Kopp, noted his former adviser’s position at the company before voting to approve the deal.

Maryland Solar will get $24 million in federal subsidies for the project.

Maryland’s renewable energy goals calls for using solar energy for 2 percent of the state’s overall power needs by 2022. That would require the state to have between 1,000 and 1,200 megawatts of solar power. The state currently only has about 20 megawatts of solar energy.  (The Daily Record, 7/27/2011)

Yale 360 Could Not Find Black People Re Environment Issues

Brentin Mock, left, challenges traditional 'environment-think' in his piece, "Yale Can Find No People Of Color Who Can Talk About Environment."  Mock points out that a recent blog post from Yale 360 asked ten environmental experts what they think of President Obama’s record on the environment, but not one person of color is featured in this forum. We responded to him that it is the same now as it was 30 years ago.  Mock comments:

"But why no one from African-American, Hispanic or Native American communities to speak on this? These communities are some of the most vulnerable to lax environmental regulation and enforcement. Black families are more likely than white families to live close to polluting facilities, and not because they choose to."
Fortunately, Blacks have formed their own environmental organizations to address these issues.  It is partially why we formed AAEA in 1985.  Interestingly, we now have a green president, who is also balanced in his environmental approach and a black EPA administrator (Lisa Jackson).  Of course, we've had a black Department of Energy Secretary (Hazel O'Leary) and a black Nuclear Regulatory Commission chairwoman (Shirley Jackson) during the Clinton administration.  Jerome Ringo, was elected as chairman of the National Wildlife Federation a few years ago.  Yet, the mainstream environmental movement is neither interested in, or capable of, representing the views of the African American community.  That does not mean that some brave blacks should not work for these groups.  God bless the handfull working there now just as a handful did about 30 years ago.

According to Mock, Roger Cohn, editor of Yale 360, responded to his inquiry in an email:

“The issue you bring up is not one we're unaware of, and it's something that is a real issue in the environmental world. We did ask a person of color, Van Jones, to participate in this forum, but we never received a response from him.  In this forum, we were focused on national environmental policy leaders -- a field that is not very diverse; but having said that, we could have tried harder to make sure that we had at least one person of color represented here.”
Again, this quote could have come from 30 years ago.  It will probably be applicable 30 years from now. (theLoop21, 7/27/2011)

When Xenophobia is in the Family




You think you know someone. Then you find out that a couple of "liberals" in your family are just as xenophobic as your average conservative.

So I think I'm having this friendly conversation about how great it is that my daughter is in a dual-immersion Spanish-English school, when all of a sudden a set of parents (in my family no less) tell me that they moved to another city because they heard Spanish being spoken in the classroom when they enrolled their child in school. So much for integration. 

The concept of "white flight" I didn't fully comprehend until I saw first hand that even "liberals" embrace the fear of "other" when it comes to enrolling their child in a school with children of another background. 

I attempted to explain that speaking Spanish does not lower your IQ. In fact, being bi-literate, if it doesn't increase your IQ, it will at least increase your knowledge. And with the requirement of a second language for most college bachelor degrees, one would think that bilingual immersion is the only obvious choice for a serious academic path.

Does the Breakdown of Talks Signal That A Debt Deal May Be Near?

This is just a hunch, but a deal on the debt ceiling may be approaching precisely because the Republicans have broken off talks with the White House. Ever the optimist, I want to view this as last-minute posturing; the parties are testing one another's resolve. A game theorist might describe it as a game of chicken in which neither "driver" - Boehner or Obama - has yet swerved, so that their cars remain on a collision course. One, probably both, are still likely to swerve before it's too late. As California Republican Dan Lungren, a nine-term representative in Congress observes (here), "I've been here long enough to see us go to the brink many times, and normally we find some way to avoid going over the top."

Each party has an incentive to hold-out for marginal last minute concessions by the other, even if the bulk of the deal is already agreed (which may or may not be the case). With last minute concessions in hand, members of each party could return to their constituents claiming some sort of political victory (or, at least, non-defeat).

On the other hand, I could be completely wrong, and we could be locked in a state of abnormal politics in which ideological purity trumps incremental change.

CASEnergy Coalition Reaching Out To Minorities: Interesting

AAEA's Criticism Finally Convinces the CASEnergy Coalition To Reach Out To Minorities

Imagine my surprise when I was reading through The Washington Informer newspaper and ran up on an ad from the CASEnergy Coalition.  It was a very pleasant ad promoting nuclear power and featured a picture of Hilda Pinnix-Ragland, who is chair of the CASEnergy Coalition Business, Labor & Minority Steering Committee and V.P., Corporate Public Affairs, Progress Energy Service Company.  To put it mildly, I was shocked because AAEA decided to withdraw from this coalition in 2006 right after it was created due to the hostility shown to us.  It was the first and only time we have withdrawn from a coalition.

We are delighted that this coalition has decided to reach out to the minority community.  However, this community should BE AWARE of the treatment afforded AAEA when the prospect of a 'Nuclear Renaissance' was budding, and we were basically kicked off of the renaissance bus.  Does this newfound interest have anything to do with the changed landscape since AAEA first publicly complained about the CASEnergy Coalition hostility towards us in 2007? Hmmm.  Let me see: Black president, black EPA administrator and black Nuclear Regulatory Commission (NRC) Commissioner (Bill Magwood). Add to that the power of the internet (our blog complaint is and has been first page when you Google CASEnergy Coalition) and maybe it makes sense now for them to start reaching out to minorities.  Fate does seem to have a sense of humor.

FUKUSHIMA DAIICHI CHANGED THE PLAYING FIELD AND ANTIS ARE ORGANIZING

AAEA was the first environmental group to support nuclear power.  I was the first environmentalist in the United States to support nuclear power.  We did not just support the technology in theory, we went out and actively spoke before groups and testified before the Nuclear Regulatory Commission (NRC), among numerous other activities.  You would never know this if you only relied on the CASEnergy Coalition because they completely ignore our contributions to the movement to support nuclear power.  In fact, CASE co-chair Patrick Moore has gone out of his way to exclude AAEA and Norris McDonald from mention in any venue, publication or public appearance.  AAEA had to call out another environmentalist (Stewart Brand) for doing the same thing.  It appears that as soon as mainstream environmentalists began to come out in support for nuclear power, they proceeded to exclude AAEA from mention.  This burns because AAEA has a long history of 'calling out' the environmental movement for its segregationist and elitist history.

Now CASEnergy Coalition can do whatever it wants to do.  No problem there.  However AAEA was created in part to increase participation in the energy sector and in the environmental movement.  And we are concerned that now that the nuclear industry is struggling, they are all of a sudden reaching out to the minority community.  A nuclear power plant license costs $100 million and a nuclear plant is projected to cost $10 billion.  The CASEnergy Coalition was seeded with $8 million and Hill and Knowlton as their PR firm.  Billions of dollars are at stake and we do not want minorities to be engaged with peanuts.  AAEA has been calling for ownership stakes in nuclear power plants. 

We were called 'crazy' by just about every other environmentalist and others in 2001 for our support for nuclear power.  We were even kicked out of one environmentalist gathering due to this support. How ironic that at the same time we were being vilified by environmentalists for supporting nuclear power, we were being excluded from the feast and credit by the nuclear industry.  Sigh.  No blue jobs created via our nuclear power support. Let us hope blue jobs are created at other minority entities.

So we praise the outreach by the CASEnergy Coalition.  Yet, we note that Blacks do not own any energy resources and infrastructure in the United States.  The environmental movement is as segregated as ever.  And the United States has a history of excluding appropriate credit for Black achievement.  AAEA's achievements being ignored by CASEnergy Coalition is just one more example of this awful history.  So we hope that they engage the minority community on a substantive level, but those participants should also BE AWARE. {Note: Substantive does not mean plane tickets, hotel rooms, meetings, dinner party contracts and photo ops}

Evans Blows Away the Schlecks

Cadel Evans is one of the world's best time-trialists. The Schleck brothers - not so much. It wasn't that they Schlecks rode badly - both finished in the top 20 to at least preserve the lower two steps on the podium in Paris tomorrow. But Evans rode like a man possessed. He started fast and stayed fast for the entire course, and came in second on the stage behind Tony Martin.

Evans will be Australia's first-ever GC winner, and he heartily deserves his yellow jersey. Often accused of riding too defensively in the past, this year he rode with finely controlled aggression and with the support of the strongest team he's ever had.  

Ultimately, the GC contest of  Tour de France tests all riding skills. The winner has to be able to climb well, descend well enough, TT with the best, and be careful and lucky enough to avoid the early-stage crashes. This year, the difference between Evans and the Schlecks really boiled down to the TT and, to a lesser extent, the descents. Unlike Contador and several of the other contenders, the three podium finalists avoided all the crashes. Some of that is luck, of course, but it's also an indication of good team management, placement in the peloton, and team work.

Two other contests were settled in today's TT. Yesterday's winner on the Alpe d'Huez, Pierre Rolland, confirmed for the white jersey (for best young rider), and Garmin-Cervelo wrapped up the team contest. At the end of yesterday's stage, Sammy Sanchez secured the polka-dot jersey for the best climber. All that remains for tomorrow's final is to see who wins the points contest for the green jersey. Mark Cavendish currently holds a fairly slim 15 point advantage over Jose Joaquin Rojas. Those two, and their teams, will duke it out on the Champs Elysee. HTC-High Road's well-tuned lead out train must give Cavendish the advantage, though Rojas will undoubtably be right on his wheel, hoping for any kind of miscue. If Cavendish wins, he will be the first citizen of the UK to win the green jersey.

Outside on the Bike

I just came in from a short bike ride in the neighborhood with my son - my first ride since my left knee was scoped (for a meniscus tear) three weeks ago today. It felt great (if a little hot and bumpy) to be cycling outdoors again. I started very conservatively, just spinning at about 12 mph, but I wanted to test the knee a bit (without overdoing it), so I got up to around 18 mph with no tweaks or twinges. I consider it a successful experiment. Hopefully this means I can pack up my trainer for the rest of the summer. Still, I'm not planning on any hard jumps, standing efforts, or hill climbs for at least another few weeks. That will be a tough commitment to keep after we complete our move to Bloomington next week; I haven't yet found any flat roads to ride there.

Still Unsettled at the Emirates

As the transfer season draws to a close and the Premier League season approaches, it remains far from clear which players will start the season in an Arsenal uniform. This situation is not all that unusual. Arsene Wenger is known for working quietly and pulling off transfers just before the window closes. But the stories coming out over the last 24 hours are, if true, quite disturbing. According to one, Wenger admits that Samir Nasri's situation is not yet sorted out (see here). Meanwhile, The Independent is reporting (here) that a Barcelona VP has arrived in London to negotiate the transfer of Cesc Fabregas. Losing either of those players, just weeks before the new season kicks off, would be bad. But to lose both could be, if anything, more disastrous than last season's last collapse.

Meanwhile, there's no sign of a new defensive signing, which is desperately needed (no matter what Wenger says in the press about the quality of his defensive unit). The only news on that front is that Everton's Phil Jagielka has rejected a move to the Emirates (see here); Everton seem willing to sell him but have rejected Arsenal's initial offer. If Fabregas goes to Barca, 19-year-old defensive midfielder Oriol Romeu could well  move in the opposite direction as partial compensation. That would help to fill the roster spot left following Denilson's departure on loan to Sao Paulo. However, to the extent lack of experience and mental toughness were Arsenal's chief problems last year, no improvement (yet) appears in sight for this season.

UPDATE: Arsene Wenger has just reassured fans that he "certainly" will sign a defender yet this summer (see here), although he is, as usual, playing his cards close to his vest.

Principles of Law and Economics, 2d Edition

The second edition of Cole and Grossman, Principles of Law and Economics (Aspen 2011) is now available, just in time for the fall semester (here). Here is what Tom Schelling has to say about the book (from the back cover): "I'm an economist who has taught economics and public policy to law students. This is the book I would have used if the authors had got around to it a couple of decades earlier."

Schleck or Evans?

Well, it looks like Voeckler's out of the race for yellow. He finally cracked today on the famed Alpe d'Huez, falling into fourth place, with little or no chance of recouping time in tomorrow's time trial or Sunday's stately promenade into Paris (which may not be so gentile, or gentle, for the green jersey contenders).

Today's stage was animated by the controversial Alberto Contador, who looked so miserably yesterday on the climb up the Galibier. Amazing that he could recover so quickly and thoroughly from his extreme fatigue and inflamed knee to attack on the Alpe d'Huez just 24 hours later. If he hadn't faded towards the end of today's climb - he was overtaken before the finish by Pierre Rolland, the impressive young French climber from Europcar - I would be even more suspicious.

Meanwhile, Andy Schleck and Cadel Evans are the two riders left to fight for the GC. Evans is by far the better time-trialist, and must be favored going into the final stage of real competition for the GC. He should be able to take at least one minute out of Schleck, who currently leads him by 57 seconds. We should not underestimate, however, Schleck's desire or the effect of wearing the yellow jersey. Who knows, he may ride the TT of his life tomorrow. And his disadvantage to Evans won't be so great on the hilly terrain around Grenoble as it would have been on a flatter TT course. So, even though Evans should be favored, no one should write off Schleck before he starts down the ramp.

Emotions on Immigration topics run High


I ran across this epic comment on an Immigration blog post and felt compelled to re-post the comment.

The topic is very serious, very sad and his over the top anger is funny at the same time.

"And let’s continue with the policy of reducing human beings to nothing more than their economic function. Nothing else matters – not culture, not sentiment, not family, not history, not morals. Just how much goddamned labor one goddamned person can produce per goddamned hour, for whatever goddamned price businesses want to pay – and not a goddmaned penny more!" -Bubba
